1. Infor­ma­tion about the col­lec­tion of per­son­al data

In the fol­low­ing we inform about the col­lec­tion of per­son­al data when using our web­site. Per­son­al­n­da­ta is all data that is per­son­al­ly avail­able to you, e.g. name, address, e‑mail address­es, user behaviour.

If we use con­tract­ed ser­vice providers for indi­vid­ual func­tions of our ser­vice or wish to use your data for adver­tis­ing pur­pos­es, we will inform you in detail below about the respec­tive trans­ac­tions. In doing so, we also name the spec­i­fied cri­te­ria for the stor­age duration.

2. Your Rights

2.1 You have the fol­low­ing rights with respect to per­son­al data con­cern­ing you:

  • right to rec­ti­fi­ca­tion or erasure,
  • right to restric­tion of processing,
  • right to object to the processing,
  • right to data portability.

You also have the right to com­plain to us about the pro­cess­ing of your per­son­al data by a data pro­tec­tion super­vi­so­ry authority.

3. Col­lec­tion of per­son­al data when vis­it­ing our website

3.1 In the case of pure­ly infor­ma­tive use of the web­site, i.e. if you do not reg­is­ter or oth­er­wise pro­vide us with infor­ma­tion, we will only col­lect the per­son­al data that your brows­er trans­mits to our serv­er. If you wish to view our web­site, we col­lect the fol­low­ing data, which is tech­ni­cal­ly nec­es­sary for us to dis­play our web­site and to ensure the sta­bil­i­ty and secu­ri­ty (legal basis is Art. 6 (1) sen­tence DSGVO (GDPR)):

3.2 In addi­tion to the afore­men­tioned data, cook­ies are stored on your com­put­er when you use our web­site. Cook­ies are small text files that are stored on your hard dri­ve assigned to the brows­er you are using and by which the body that sets the cook­ie (here through us) receives cer­tain infor­ma­tion. Cook­ies are not able to run pro­grams or trans­mit virus­es to your com­put­er. They serve to make the inter­net offer more user-friend­ly and effec­tive overall.

3.3 Use of cookies:

a) This web­site uses the fol­low­ing types of cook­ies, the respec­tive scope and oper­a­tion are explained below:

— per­sis­tent cook­ies (see c).

b) Tran­sient cook­ies are auto­mat­i­cal­ly delet­ed when you close the brows­er. These include in par­tic­u­lar the ses­sion cook­ies. These store a so-called ses­sion ID, with which var­i­ous requests from your brows­er can be assigned to the com­mon ses­sion. This will allow your com­put­er to be rec­og­nized when you return to our web­site. The ses­sion cook­ies are delet­ed when you log out or close the browser.

c) Per­sis­tent cook­ies are auto­mat­i­cal­ly delet­ed after a spec­i­fied peri­od, which may dif­fer depend­ing on the cook­ie. You can delete the cook­ies in the secu­ri­ty set­tings of your brows­er at any time.

This web­site uses the cook­ie “cook­ie ban­ner”. This cook­ie is gen­er­at­ed by our cook­ie ban­ner and rec­og­nizes that it has been con­firmed before. The cook­ie is delet­ed after one year.

This web­site also uses a cook­ie “__cfduid”. This cook­ie is need­ed for the Con­tent Deliv­ery Net­work Cloud­flare, so that access to our web­site is as fast as possible.

d) You can con­fig­ure your brows­er set­ting accord­ing to your wish­es and e.g. decline the accep­tance of third-par­ty cook­ies or all cook­ies. Please be aware that you may not be able to use all func­tions of this website.

4. Con­tact Form

When you con­tact us by e‑mail or through a con­tact form, the infor­ma­tion you pro­vide (your e‑mail address, your name and tele­phone num­ber if applic­a­ble) will be stored by us to answer your ques­tions. We delete the data that aris­es in this con­text after the stor­age is no longer required, or lim­it the pro­cess­ing if there are statu­to­ry reten­tion requirements.

The legal basis for the pro­cess­ing of the data trans­mit­ted in the course of send­ing an e‑mail is Arti­cle 6 (1) lit. f DSGVO (GDPR). If the e‑mail con­tact aims to con­clude a con­tract, then addi­tion­al legal basis for the pro­cess­ing is Art. 6 para. 1 lit. b DSGVO (GDPR).

5. BU TechShare

5.1 We offer select­ed cus­tomers the oppor­tu­ni­ty to reg­is­ter for the use of our cus­tomer por­tal BU TechShare by pro­vid­ing per­son­al data. Reg­is­tra­tion takes place via the account man­ag­er respon­si­ble for you.

Via the cus­tomer por­tal BU TechShare reg­is­tered cus­tomers can choose accord­ing to the cho­sen tar­iff (econ­o­my tar­iff, stan­dard tar­iff or com­fort tar­iff) to:

  • cre­ate an indi­vid­ual user profile
  • see all tech­ni­cal data sheets, spec­i­fi­ca­tions, oper­at­ing instruc­tions and spare parts lists for their engines pur­chased from us
  • view impor­tant announce­ments and news con­cern­ing their engines bought from us, view the cal­en­dar func­tion and plan appointments
  • file com­plaints and fol­low the pro­cess­ing progress
  • upload data to exchange with our engineers
  • syn­chro­nize BU TechShare with their mobile devices so that the above men­tioned data is avail­able offline and auto­mat­i­cal­ly updat­ed as soon as it is online again
  • set up sub­ac­counts for their customers

5.2 When reg­is­ter­ing through a cus­tomer ser­vice rep­re­sen­ta­tive, the fol­low­ing data will be col­lect­ed and stored as part of the reg­is­tra­tion process for each cus­tomer account to be set up:

  • com­pa­ny name
  • first giv­en name
  • sur­name
  • e‑mail address

As part of the reg­is­tra­tion process, the con­sent of the user to process this data is obtained. As a user, you have the option of can­cel­ing the reg­is­tra­tion at any time. A dis­clo­sure to third par­ties does not occur.

5.3 If you use our por­tal, we will store the data required for the ful­fill­ment of the con­tract until you final­ly delete your access. Fur­ther­more, we will store the vol­un­tary data pro­vid­ed by you for the time of your use of the por­tal, unless you delete it before. All infor­ma­tion can be man­aged and changed in the pro­tect­ed cus­tomer area.

Legal basis for the use of your data is in the cas­es of your con­sent Art. 6 para. 1 lit. a DSGVO (GDPR).

6. BU WebWarehouse

6.1   We offer select­ed cus­tomers the oppor­tu­ni­ty to reg­is­ter for the use of our cus­tomer por­tal BU Web­Ware­house by pro­vid­ing per­son­al data. Reg­is­tra­tion takes place via the account man­ag­er respon­si­ble for you.

Via the cus­tomer por­tal BU Web­Ware­house reg­is­tered cus­tomers can place spare parts orders and retrieve the his­to­ry of their already placed orders.

6.2   When reg­is­ter­ing with a cus­tomer ser­vice rep­re­sen­ta­tive, the fol­low­ing data will be col­lect­ed and stored as part of the reg­is­tra­tion process for each cus­tomer account to be set up:

  • com­pa­ny name
  • first giv­en name
  • sur­name
  • e‑mail address

As part of the reg­is­tra­tion process, the con­sent of the user to process this data is obtained. As a user, you have the option of can­cel­ing the reg­is­tra­tion at any time. A dis­clo­sure to third par­ties does not occur.

6.3   If you use our por­tal, we store your data required for the ful­fill­ment of the con­tract until you finally

delete your access. Fur­ther­more, we will store the vol­un­tary data pro­vid­ed by you for the time of your use of the por­tal, unless you delete it before. All infor­ma­tion can be man­aged and changed in the pro­tect­ed cus­tomer area.

Inso­far as you place orders via the cus­tomer por­tal, we are required by com­mer­cial and tax reg­u­la­tions to store your address, pay­ment and order data for a peri­od of ten years. How­ev­er, after two years we are restrict­ing pro­cess­ing, i.e. your data will only be used to com­ply with legal obligations.

Legal basis for the use of your data is in the cas­es of your con­sent Art. 6 para. 1 lit. a DSGVO (GDPR) and in the case of con­tracts con­clud­ed via the cus­tomer por­tal Art. 6 para. 1 lit. b DSGVO (GDPR).

7. Newslet­ter

7.1     If we have received your e‑mail address in con­nec­tion with the pur­chase of a ser­vice or the pur­chase of goods and you have not object­ed to the use of your e‑mail address, we will inform you in the future about your own sim­i­lar goods or services.

The legal basis is Arti­cle 6 (1) (1) (f) DSGVO (GDPR) and Sec­tion 7 (3) UWG.

You can con­tra­dict the send­ing of the newslet­ter at any time and unsub­scribe from the newslet­ter. You can declare the objec­tion by click­ing on the link pro­vid­ed in each newslet­ter e‑mail, by e‑mail to [email protected] or by send­ing a mes­sage to the con­tact details stat­ed in the imprint.

7.2     In all oth­er cas­es, we will only send you our newslet­ter if you have sub­scribed to it with your con­sent. Our newslet­ter informs you about our cur­rent inter­est­ing offers. The adver­tised goods and ser­vices are named in the dec­la­ra­tion of consent.

To reg­is­ter for our newslet­ter, we use the so-called dou­ble opt-in pro­ce­dure. This means that after you have reg­is­tered, we will send you an e‑mail to the e‑mail address spec­i­fied in which we ask you to con­firm that you wish to receive the newslet­ter. In addi­tion, we store your IP address­es and times of reg­is­tra­tion and con­fir­ma­tion. The pur­pose of the pro­ce­dure is to prove your reg­is­tra­tion and, if nec­es­sary, to inform you about pos­si­ble mis­use of your per­son­al data.

The only require­ment for send­ing the newslet­ter is your e‑mail address. The spec­i­fi­ca­tion of addi­tion­al, sep­a­rate­ly marked data is vol­un­tary and will be used to address you per­son­al­ly. After your con­fir­ma­tion, we will save your e‑mail address for the pur­pose of send­ing you the newsletter.

The legal basis is Art. 6 para. 1 sen­tence 1 lit. a DSGVO (GDPR).

You can revoke your con­sent to the send­ing of the newslet­ter at any time and unsub­scribe from the newslet­ter. You can declare the can­cel­la­tion by click­ing on the link pro­vid­ed in every newslet­ter e‑mail or by e‑mail to [email protected] or by send­ing a mes­sage to the con­tact details pro­vid­ed in the imprint.

7.3     The ship­ping of our newslet­ter is done via MailChimp. Fur­ther infor­ma­tion on data pro­tec­tion can be found at https://mailchimp.com/legal/.

MailChimp will only use your infor­ma­tion to send our newslet­ter as described above. A pass­ing on to third or for use for oth­er pur­pos­es does not take place.

The legal basis for for­ward­ing to MailChimp is Art. 6 para. 1 lit. f DSGVO (GDPR) and a con­tract pro­cess­ing con­tract pur­suant to Art. 28 (3) sen­tence 1 DSGVO (GDPR).

8. Google Analytics

This web­site uses func­tions of the web analy­sis ser­vice Google Ana­lyt­ics. The provider is Google Ire­land Lim­it­ed (“Google”), Gor­don House, Bar­row Street, Dublin 4, Ireland.

Google Ana­lyt­ics enables the web­site oper­a­tor to analyse the behav­iour of web­site vis­i­tors. In doing so, the web­site oper­a­tor receives var­i­ous usage data, such as page views, length of stay, oper­at­ing sys­tems used and the ori­gin of the user. This data is sum­marised in a user ID and assigned to the respec­tive end device of the web­site visitor.

Fur­ther­more, Google Ana­lyt­ics allows us to record your mouse and scroll move­ments and clicks, among oth­er things. Fur­ther­more, Google Ana­lyt­ics uses var­i­ous mod­el­ling approach­es to sup­ple­ment the data records col­lect­ed and uses machine learn­ing tech­nolo­gies in the data analysis.

Google Ana­lyt­ics uses tech­nolo­gies that enable the recog­ni­tion of the user for the pur­pose of analysing user behav­iour (e.g. cook­ies or device fin­ger­print­ing). The infor­ma­tion col­lect­ed by Google about the use of this web­site is usu­al­ly trans­ferred to a Google serv­er in the USA and stored there.

The use of this ser­vice is based on your con­sent accord­ing to Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG. The con­sent can be revoked at any time.

Order pro­cess­ing

We have con­clud­ed an order pro­cess­ing con­tract with Google and ful­ly imple­ment the strict require­ments of the Ger­man data pro­tec­tion author­i­ties when using Google Analytics.

9. Cloud­flare

This web­site uses SSL encryp­tion for secu­ri­ty rea­sons and to pro­tect the trans­mis­sion of con­fi­den­tial con­tent, such as requests you send to us as a site oper­a­tor. You can rec­og­nize an encrypt­ed con­nec­tion by the fact that the address line of the brows­er changes from “http://” to “https://” and by the lock sym­bol in your brows­er line. If SSL encryp­tion is acti­vat­ed, the data you trans­mit to us can­not be read by third par­ties. In order to be able to offer you secure data trans­mis­sion on our web­site using SSL encryp­tion, we use the ser­vice of Cloud­flare, Inc. 101 Townsend St San Fran­cis­co, CA 94107. We have con­clud­ed a cor­re­spond­ing agree­ment with Cloud­flare based on the DSGVO for order pro­cess­ing. Cloud­flare is a cer­ti­fied par­tic­i­pant of the EU-US Pri­va­cy Shield Frame­work. Cloud­flare is com­mit­ted to han­dling all per­son­al data held by Euro­pean Union (EU) mem­ber states in accor­dance with the Pri­va­cy Shield Frame­work and its applic­a­ble prin­ci­ples. Fur­ther infor­ma­tion about the Pri­va­cy Shield Frame­work can be found on the US Depart­ment of Com­merce’s Pri­va­cy Shield list at [https://www.privacyshield.gov]. Cloud­flare col­lects sta­tis­ti­cal infor­ma­tion about vis­its to this web­site. Access data includes: name of the web­site accessed, file, date and time of access, amount of data trans­ferred, noti­fi­ca­tion of suc­cess­ful access, brows­er type and ver­sion, the user’s oper­at­ing sys­tem, refer­rer URL (the pre­vi­ous­ly vis­it­ed page), IP address and the request­ing provider.
